Cardinal Drivers Reach Settlement In Wage Lawsuit
There have been many cases against trucking companies in which they have classified their drivers as independent contractors. A group of drivers filed a lawsuit against Cardinal Logistics Management Corp. alleging that Cardinal misclassified drivers as independent contractors. The drivers allege that they were employees, as opposed to independent contractors, and the misclassification allowed Cardinal to be relieved of the obligation to reimburse the drivers for any and all employment claims. The drivers also contend that Cardinal avoided giving them required meal and rest breaks, avoided keeping itemized wage statements and paying for workers’ compensation insurance. The parties have reached a settlement which would require Cardinal to pay $3.75 million to create a settlement fund.

This is and has happened all over the country with cardinal. They stated to me they will never be caught 100 percent by various state departments nor Federal tax people. I worked for the for seven years and have file upon file of wrong-doing by the company. My company (dispatch) I was accountable was Rochester, NY. Their new manager (within 4 yrs) has a boatload of issues himself (I can not state at this time). They have been doing this :lie” since they took over the deliveries from Home Depot when they decided to give up their own drivers. They are also providing the same services for Eastman Kodak, Rochester, NY; Papa Johns, Pittsburgh, PA; and distribution for 7-11 stores from their various distribution centers. I have legal action pending. I am waiting for “due process” now. Best of luck if you deal with. They also usually do not bother to repair their equipment uses everyday. This creates a very special needless safety situation.
