According to a report from the National Association of Insurance Commissioners, (NAIC) the top five reasons consumers filed formal complaints against their insurance companies in 2008 were delays, denials of claims, unsatisfactory settlement offers, premiums and rating, and cancellations. The NAIC collected the data through its centralized electronic Complaint Database System, through which states voluntarily report “closed” complaints. A total of 195,669 confirmed consumer complaints on insurance companies were reported in the 2008 calendar year. Accident/health and auto insurance coverage were the target of the most complaints, followed by homeowners, life and annuity, and commercial multi-peril. Based on our litigation experience fraudulent conduct would be a factor in many of the categories of complaints referred to above.
