A wrongful death lawsuit has been filed by the mother of an 18-month-old who drowned in a hot tub at a North Las Vegas day care center back in January. The suit, filed in a state court, alleges Marisela’s Family Day Care Center was negligent in failing to care for the infant. The child died after he and another child, who was three years old, were found in a hot tub attached to a pool at the home-based day care. The three-year-old survived, but tragically the infant didn’t. The day care’s city business license has been canceled and it no longer is in operation.
It was alleged in the lawsuit that the day care facility held itself “out to the public and to Plaintiffs as being skilled, careful and diligently able to supervise, safeguard and protect the children under its care and supervision.” Instead, the suit charges, the child who drowned “was caused to wander about the back yard, with no safety precautions in place. Facilities that care for children have a duty to take all reasonable means available to protect them. When they fail to do so, the consequences can be deadly, as in this case.
