Our firm and two other law firms are representing the family of Art DeCarlo, a former professional football player, who has been posthumously diagnosed with a serious brain condition. The lawsuit against the National Football League (NFL) was filed in a New York state court. Arthur DeCarlo Jr., representing the estate of his father, our client, opted to pursue an individual claim rather than participate in a settlement that had been challenged by some former players. We allege that the NFL failed to protect or warn its players even though it knew about the dangers of concussions and other head injuries long before DeCarlo’s football career started. Art DeCarlo played from 1953 to 1961. Our complaint comes as a number of NFL players are trying to overturn the league’s uncapped head injury settlement in the Third Circuit.
The DeCarlo family is represented by Dee Miles, Rebecca Gilliland and Leslie Pescia from our firm, along with Wendy R. Fleishman of Lieff Cabraser Heimann & Bernstein LLP, and Thomas O. Sinclair and M. Clayborn Williams of Sinclair Williams LLC. The case is DeCarlo v. National Football League in the Supreme Court of the State of New York, County of New York.
