The Deepwater Horizon Economic and Property Damages Claims Center has continued to effectively settle claims to the satisfaction of claimants. As of July 31, 2015, public statistics show that more than 356,000 claims have been filed, with Florida residents and businesses filing (28.7%), followed closely by Louisiana (28.6%), Alabama (16.8%), Mississippi (11.9%), Texas (5.3%), and other states (8.7%). Nearly 10% of the filed claims were filed shortly before the claims-filing deadline of June 8, 2015. Business Economic Loss claims account for 35.3% of the claims processed, while Individual Economic Loss (18.3%), Subsistence (14.4%), Coastal Real Property (11.3%) and Seafood Compensation Program (6.8%) trail.
The Claims Center has offered more than $6 billion in Eligibility Notices and issued approximately $5.3 billion in payments. Business Economic Loss claims received almost $2.97 billion in payments, with Seafood Compensation Program at $1.479 billion, VoO Charter Payment at $278 million, and Coastal Real Property and Wetlands Real Property claims at $150 million and $157 million respectively. This is welcome news as nearly 93% of claimants are accepting the offers made to them under the terms of the Settlement.
BP continues to appeal claims at a rate of more than 3 to 1 of Claimant appeals, challenging various aspects of the claim determinations. While some of the appeals may be justified, it has been our experience that many of BP’s appeals are oftentimes nothing more than a delay or tactic to avoid payment. Predictably, BP is losing many of these appeals while also having to foot a penalty for filing them. Our firm has been very successful in protecting our clients’ claims in the appellate process.
