None of the lawyers in our firm who handle whistleblower litigation were surprised to learn that the U.S. Department of Justice (DOJ) is heading toward another record year of False Claims Act (FCA) settlements. That’s quite apparent since more than $2 billion of settlements were reported in the first six months of 2014. Three settlements totaling $1.2 billion were financial, involving JPMorgan Chase & Co., SunTrust Banks Inc. and U.S. Bank. They were related to mortgage origination and underwriting practices. There most likely will be more activity in that area of concern. Based on the enormity of wrongdoing in the financial section, I am reasonability sure this area of litigation will continue to grow.
