Dollar General Litigation

Our firm has filed a nationwide collective action on behalf of all store managers against Dollar General involving the Fair Labor Standards Act (FLSA). We allege in the suit that Dollar General classified employees as “manager” (meaning the company did not pay them overtime for the hours worked more than 40 hours per single work week), without assigning these “managers” with any real “manager duties.” Stated differently, Dollar General misclassified employees to keep from paying overtime wages as required by law. There are more than 3,500 Plaintiffs in the collective action. This case is scheduled for trial in May.

i was made to work off the clock on my lunch breaks in store 3910 in springtown tx 76082.had to take phone outside with me&could not leave the parking lot..i think that is wrong…

I was a mgr at one of there stores,was paid to work forty hrs,but worked 60 to 80 hrs a week,etc

The company REQUIRES that key holders and Assistant Managers work off the clock. They say they expect you to ‘make it up’ later but that is ridiculous and so wrong. By only giving enough payroll for two people – one cashier and one manager-on-duty to be present at any given time the MOD does NOT get a true break. While on break the MOD is required to assist the cashier, answer the phone, handle returns and any complaints, check in vendors, etc. while remaining ‘on break’. Obviously the MOD is not allowed to leave the store for any reason, not even to go to the bank, which often results in the cashier being sent to get change (which they are not supposed to do). This also results in leaving the MOD alone in the store for periods of time.

LOL Been there did that worked 60 plus hours a week off the clock cleaned stocked and wash floors ect. Couldn’t even go to the bath room cause I had to do all that and run the cash regs. It was hell. I’m sure thais law suit will go on and on I wonder if there will ever been a end to this

I was a manager who withdrew from the Class Action suit. I elected to not deal with the ongoing process that Dollar General will press on for years and years with teams of attorneys throughout the East and Southeast.

I worked many weeks in excess of 80 hours. Classifying people as “Store Manager,” then cutting labor dollars while forcing the Mgr. to pick up the slack. Their defense? They claim that their Managers are “Executives,” therefore they do not have to pay overtime. Whew, I was an executive? LOL

Strange enough, when Dollar General elected to go public with a % of their stock, they would offer stock to “executives” such as Regionals and District Managers but never to Store Managers. Hmmm. What about our Executive status?

I spent as little as 30 minutes a day in the office doing “managerial” work. I could not hire, fire or even discipline without express approval of my D.M. according to company policy. I would come in at 5 a.m. and stock until 7:30. Then, a dash to the bank and back in time to open store which I would often run by myself until a clerk would arrive at 10 a.m. due to labor cuts.

The year prior to me taking this store, it grossed $1.1 million in sales and had three consecutive years of $110,000 in shrink. My first year in the store, $1.7 million in sales and shrink cut to $60 grand. I was forced to resign December 23 of 2009 as I was struck by a fleeing thief on the parking lot attempting to get their tag number, as directed by DM and RM and Police. Although sales were up again and we were on track for just over $2 million in sales and a $50 grand shrink, I was harrassed and forced to resign. Three years later, I am still fighting with DG attorneys on injury and although they have claimed that they are responsible in the first court appearance, they continue to deny that I was injured. LOL

A rotten company ran by high powered attorney’s and investors, who also happen to own Toys R Us, Hunts, Target and over 100 other companies world-wide.

I worked for this company for 12 years, when finally enough was enough! I ran their number 1 store in Region 64 for years and each year the more money and profit I made them the fewer and fewer payroll hours I would get. Thet had us unloading trucks alone, running register alone, stocking shelves alone with trucks being received of over 2600 to 3000 cartons. The DM”S and Regional mgrs and higher up got bonuses based on the profit EBIDA but not us Store mgrs. We mopped the floors, fixed plumbing problems,cleaned parking lots, changed lighting issues and fixed the register and computer issues. We were not managers but Jack of all trades. My manager skills were about 1 hour a day of a 50 to 60 hour work week.

When I first started at Dollar General over 6 years ago it was the best job I had ever had, Then KKR stepped in and we, as managers, became slaves and pretty much were told to give up family, friends, church, time off, use vacation pay to pad labor hours, work 60, 70 80+ hours a week and be “appreciative” of our “salaries”. The list can go on but I doubt anyone really cares if they are a DM or higher. The things that my team and I accomplished at store #6274 had NEVER been done before. Community involvement, which raised ours sales by an avg. of 40% a year until they raised our goals so high or put a brand new store and building 5 miles away while the summer of 2012 our air conditioner stayed broken all summer and we worked in an avg. of 90-95 degree heat everyday. Any manager who is reading this could add 100′s of more incidents or situations so I won’t. I suffered a nervous breakdown 9/11/12 due to work stress per my doctors and the staff at the day program at a psychatric facility that I have been in twice since that September day last year. I still can’t even pull into the parking lot to wait for my sister to go in to this store without crying and having a panic attack. It’s all we have in our little town so we don’t have a choice but to shop there when we need something. Not that Dollar General cares but not only did my mental and physical health suffer GREATLY I would like to say thank youto them for being a huge part of why my husband divorced me (he never got to see me unless he came to the store because of open to closes for 3 months straight) , I missed family funerals, my childrens sports events and school functions, never getting to go to church, doctors appointments canceled over and over and much more! The “G” in DG really means and stands for GREED!!!!!!!!!!!

I also want to be part of this lawsuit!! How do I do it??

I too am part of this lawsuit. When we had to fire an assistant manager for violations my DM didnt get me anyone for a month: so I worked 60-80 a week no assistant manager leading into the holidays. I also left because of harassment from a DM but thats another story.

Is there any status updates ?? I do know of another manager who was in my district and she got a check for $1000.00 as part of her suit

I really would like to get involved with this lawsuit! Not for the money but to let everyone know how Dollar General treats there employees. I was at DG in a small town for 5 yrs a manager for 2 I never got Holidays off I had to work all of them and most of the time I was the only one in the store for long periods at a time by myself running the store. They would always cut my budget in the middle of the week therefore I had to cover those shifts too. I worked open to close to save payroll.I realized how unfair they where when they told me I had to find someone from another store or I could not go to my own daughters wedding!! I really needed my job so I could not just quit….but I did find someone to work my store.I worked 70 to 80 hrs a week and when my youngest daughter had her first prom her dad had to take her dress shopping because I had to work so much.My stress level was always so high I just cried myself to sleep because I was so tired.When I would finally find a way to take a day off my DM would call me and ask me to go to the store to get some information for him of the computer. So usually when that happened I just stayed and did more work!! We never clocked in or out that was not allowed! I lost 55lbs and got really sick and my docter told me that DG was going to get the best of me but I still went everyday sick or not! Dollar General is a great big company they have sponsers they give millions of dollars to like Nascar!! They need to spread some of that money in their companies to help their store managers by giving them a better budget so their employees can get a break!! I finally had to quit because I almost got a divorce from my husband of 14 yrs over DG!!! My husband was willing to leave me and my kids over this job. My family is more to me than DG ever was I made the right choice!!!Thanks I hope every DG employee gets the respect they deserve!!Thank you………..
