In 2000, our firm decided to get involved in Mass Torts Litigation in a big way. When we handled cases in the massive Fen Phen litigation, the firm realized that a change was needed. Once the Fen Phen litigation started, it received a great deal of national media attention. As a result, news of other drug withdrawals from the market such as Propulsid and Rezulin were made public. Our Board of Directors decided to create a new section in the firm exclusively devoted to Mass Torts Litigation, with a specialty in pharmaceutical drug litigation.
Andy Birchfield was moved from our Fraud Section and he was given the responsibility to run the new Section. That decision has turned out to be one of the best moves we have ever made. The Section grew quickly from a handful of employees and lawyers to over ten lawyers and 100 support staff by the end of 2001. We now have 16 lawyers and 62 support staff in the Section.
In addition to drug withdrawals in 2001, lawyers in the new Section recognized a problem with the drug Vioxx from a study called the VIGOR study. We quickly learned there were serious safety-related problems with Vioxx. We filed our first Vioxx cases in the Fall of 2001. Our firm was subsequently selected to help lead that litigation on the national level. Andy Birchfield was named as co-lead counsel of the Vioxx MDL in New Orleans. He was largely responsible for the $4.85 billion dollar global settlement of the Vioxx cases with Merck & Co. that was agreed to on November 9, 2007. It has taken about four years to complete the settlement, which is very good considering the vast amount of work involved and the complexity of the case.
The Mass Torts Section, since its creation in 2001, has been involved in litigation involving many major mass torts. In addition to Vioxx, included are Fen Phen, Propulsid, Rezulin, Serevent, Baycol, Meridia, Lotronex, Bextra, Celebrex, Hormone Replacement drugs, Yaz, Fosamax, Gardisil and several others. The Section also handles medical device cases such as Sulzer knee, Medtronic claims, shoulder pain pumps and DePuy Hips.
In addition to the Mass Torts Cases, lawyers in the Section also evaluate and handle single catastrophic injury or death cases. We have dedicated both the manpower and resources required to litigate against large pharmaceutical manufacturers all over the United States. On a daily basis, lawyers in the Mass Torts Section provide valuable assistance to folks who need help in determining if they have a Mass Torts case that should be filed in court.
