Goodyear collective action conditionally certified

A Florida federal judge has granted conditional certification to a collective action of service managers who alleged that Goodyear Tire & Rubber Co. misclassified them as exempt and failed to pay them overtime. The collective action includes current and former Goodyear service managers who have worked more than 40 hours during one or more work weeks on or after January 2008 in any U.S. state, but did not receive overtime pay. The seeks overtime compensation relief under the Fair Labor Standards Act.

Goodyear argued that the Plaintiffs were not similarly situated because the duties of service managers varied from store to store. The court pointed out, however, that a Goodyear corporate representative testified that the basic responsibilities for service managers were consistent throughout the 663 stores and there was a reasonable basis for the Plaintiffs’ claim that there were other similarity-situated employees who wished to opt-in to the action.

I do believe that there have been far to many inconsistancies with testimony from goodyear and that the court needs to recognize this and rule in the plaintiffs favor… Enough of the BS….. Goodyear is guilty and should reimburse the plaintiffs with damages…. How long should we allow an organization to try to correct what they have done wrong and give ample time to alter records

It’s time all Goodyear store managers join in this class action suit. If you, like me, have been doing most of the sales in the store and working over 55 hours a week, join in and let’s find a lawyer to represent us now.

i am a service manager for goodyear.they reduce our pay when they made us hourly because of this lawsuit. can you supply the name of the lawyers handling this case

i work for Goodyear over 9 years, and then they went to hourly, but they keep us under 40 hours, they say we will work 48 hours , wich 8 hours will be overtime, to compensate for our old salary, never happen.can you supply the name of the lawyers handling this case, thank you.
